Once Custom List Marketing compiles a list, it is delivered to the client with the understanding that the client will use the list for his/her own business purpose. Custom List marketing prohibits any unauthorized distribution and/or dissemination of its lists. Procedures are in place to identify unauthorized users.

E-Mail Marketing Legality

Marketing pieces distributed by Custom List Marketing strictly adhere to the Federal Can-Spam Bill (S.877). See the comments by Eileen Harrington, Associate Director of the Marketing Practices Division for the Bureau of Consumer Protection, at the Federal Trade Commission and Direct Magazine, concerning the upcoming Jan 1, 2004 Federal Can-Spam Bill. (S.877). It's now the Law.

Harrington: In terms of enforcement action by the Federal Trade Commission, it's simple for a company to stay on the right side of the law: Don't lie, don't mislead. This means identify the Sender in the From line; don't use deceptive or misleading statements in the subject line; don't misrepresent the product or service being offered in the text of the message; give a clear unsubscribe option and honor it. Can-Spam does not insist that Marketers get consumers to opt in before they send them e-mail. But a Hyperlink or Remove Disclaimer would be required in every e-mail so consumers can click to Unsubscribe from receiving any more messages from that Marketer. It's strictly opt-out. It gives Legitimate Businesses an opportunity to send you something, but you can say no to future e-mails.
